Terms of Sale & Licence

These terms cover your purchase and use of FirstCut, software for macOS made by Josh Butcher Online (“we”, “us”). By buying or using FirstCut, you agree to them.

What you’re buying

FirstCut is a one-time purchase, not a subscription. Buying it gives you a perpetual, non-exclusive licence to use the current version and all future updates we release, on Macs you own or control, for as long as you like. There is no recurring charge and nothing expires.

System requirements. FirstCut requires macOS 26 (Tahoe) or later on Apple silicon. This is a hard technical requirement, not a recommendation: the app transcribes on-device using Apple’s speech engine, which is not available on earlier versions of macOS or on Intel Macs. Please confirm your Mac meets this before buying.

What you may do

Use FirstCut for personal or commercial work, including paid client work.
Install it on Macs you own or control.
Keep and use everything it produces — your cuts, transcripts, and exports are entirely yours. We claim no rights over your footage or your output.

What you may not do

Resell, sublicense, rent, or redistribute FirstCut or your download link.
Reverse-engineer, decompile, or attempt to derive the source code, except where that right cannot lawfully be excluded.
Remove or alter any copyright or identifying notices.
Share the software with people who have not bought it.

Your footage and your privacy

FirstCut runs entirely on your Mac. We never receive your video, audio, or transcripts, and we have no ability to access them. See our Privacy Policy for the full picture.

Payment

Payments are handled by Stripe. Prices are shown in US dollars and may change over time, though a price change never affects a purchase you have already made. You are responsible for any taxes that apply where you live, unless collected at checkout.

We offer a 14-day, no-questions-asked refund. Full details on our Refund Policy page.

Updates and changes to the software

We release updates from time to time and you get them at no extra cost. We may add, change, or remove features as the software develops, and we may change what operating systems are supported as Apple’s platform moves. We do not promise that any specific feature will exist forever.

Any feature described as roadmap or coming soon is an intention, not a promise. Please buy based on what FirstCut does today.

Availability

We aim to keep downloads and updates available continuously, but we do not guarantee uninterrupted service. Hosting, Apple’s platform, and third-party services are outside our full control.

Warranty and liability

FirstCut is provided “as is”. While we work hard to make it reliable, we cannot guarantee it will be error-free or suitable for every workflow. Always keep your original footage. FirstCut is designed to produce a first cut from your media, not to replace your backups, and you should never treat it as the only copy of anything.

To the fullest extent permitted by law, our total liability arising from your purchase or use of FirstCut is limited to the amount you paid for it. We are not liable for indirect or consequential losses, including lost work, lost time, or lost income.

Nothing in these terms limits rights you have under consumer law that cannot lawfully be excluded.

Ending the licence

Your licence ends if you materially breach these terms — for example by redistributing the software. You may stop using FirstCut at any time.

Changes to these terms

We may update these terms. The current version always lives on this page with its date at the top, and changes are not applied retroactively to a purchase already made.
